  1. Collection and storage of personal data and the nature and purpose of their use

The use of our site is possible without providing personal data. For the use of individual services on our site, different regulations may apply, which in this case will be explained separately below. Your personal data (e.g. name, address, e-mail, telephone number, etc.) will only be processed by us in accordance with the provisions of German data protection law and any other applicable legislation. Data is considered personal if it can be clearly assigned to a specific natural person. The legal basis for data protection can be found in the EU Data Protection Basic Regulation (EU-DSGVO), in the Federal Data Protection Act (BDSG) and in the Telemedia Act (TMG). a) When visiting the website

When you call up our website, information is automatically sent to the server of our website by the browser used on your end device. This information is temporarily stored in a so-called log file. The following information is recorded without your intervention and stored until it is automatically deleted:

  • Date and time of access
  • Name and URL of the retrieved file
  • Website from which the access takes place (referrer URL)

We process the above-mentioned data for the following purposes:

The legal basis for the data processing is Art. 6 para. 1 sentence 1 letter f DSGVO. Our legitimate interest follows from the above-mentioned purposes for data collection. Under no circumstances do we use the collected data for the purpose of drawing conclusions about your person.

Furthermore, we use cookies and analysis services when you visit our website. You will find more detailed explanations on this under points 4 and 5 of this data protection declaration.

You can visit our website without providing any personal information. Every time you access our website, usage data is transmitted by your Internet browser and stored in log files (server log files). These stored data include, for example, the name of the page called up, the date and time of the call, the amount of data transferred and the requesting provider. This data is used exclusively to ensure the trouble-free operation of our website and to improve our offer. It is not possible to assign this data to a specific person.

 

b) When registering for our newsletter

If you have expressly consented in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO, we will use your e-mail address to send you our newsletter regularly for advertising purposes. To receive the newsletter, it is sufficient to provide an e-mail address. We will check the e-mail address you have entered to ensure that you are actually the owner of the e-mail address provided or that the owner has authorised the receipt of the newsletter.

The data collected in this way will be used exclusively for receiving our newsletter. It will not be passed on to third parties. A comparison of the data collected in this way with data that may be collected by other components of our site is also not carried out.

It is possible to unsubscribe at any time, for example via a link at the end of each newsletter. Alternatively, you can send your unsubscribe request at any time by e-mail to kontakt@fkon.net.

Consent Newsletter

With regard to the use of your personal data to receive our newsletter, you will be asked for your consent at the appropriate point as follows:

“I have taken note of the data protection declaration, in particular I agree that the data processing will be carried out by a service provider in the USA”.

With the newsletter we inform you about our offers at regular intervals. To receive our newsletter, you need a valid e-mail address. With your registration to our newsletter we will save your IP address and the date and time of your registration. This serves as a safeguard for us in the event that a third party misuses your e-mail address and subscribes to our newsletter without your knowledge.

 

Newsletter by MailChimp

We use the component MailChimp to send our newsletter. MailChimp is a service of The Rocket Science Group, LLC, 512 Means Street, Suite 404, Atlanta, GA 30318, USA.

Your data (e-mail address, name, IP address, date and time of your registration) will be transferred to a server of The Rocket Science Group in the USA and stored there in compliance with the “EU-US Privacy Shield”.

Newsletter Tracking

Our newsletters contain so-called tracking pixels (web bugs), which enable us to recognize whether and when an e-mail was opened and which links in the e-mail were followed by the personalized recipient.

We store this data so that we can tailor our newsletters optimally to the wishes and interests of our subscribers. Accordingly, the data thus collected is used to send personalised newsletters to the respective recipient.

We ask you to give your consent to this at the given point as follows:

“I agree that my data and my usage behavior are stored electronically by the newsletter tracking system in order to send me an individualized newsletter. By revoking your consent to receive the newsletter, your consent to the above-mentioned tracking will also be revoked.”

Your personal data will not be transferred to third parties for purposes other than those listed below.

  • you have given your express consent in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO,
  • the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. f DSGVO is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
  • in the event that there is a legal obligation to pass on the data in accordance with Art. 6 para. 1 sentence 1 lit. c DSGVO, and
  • this is legally permissible and required for the processing of contractual relationships with you in accordance with Art. 6 Para. 1 S. 1 lit. b DSGVO.

 

  1. Cookies 

We use cookies on our website. These are small files that are automatically created by your browser and stored on your end device (PC, laptop, tablet, smartphone or similar) when you visit our site. Cookies do not cause any damage to your terminal device, do not contain viruses, Trojans or other malware.

Information is stored in the cookie that is related to the specific terminal device used. This does not mean, however, that we are immediately informed of your identity.

The analysis and tracking measures listed below and used by us are carried out on the basis of Art. 6 para. 1 sentence 1 lit. f DSGVO. With the tracking measures used, we want to ensure that our website is designed to meet the needs of our customers and is continuously optimized. On the other hand, we use the tracking measures to record the use of our website statistically and evaluate it for the purpose of optimizing our offer for you. These interests are to be regarded as justified in the sense of the aforementioned regulation.

The respective data processing purposes and data categories can be taken from the corresponding tracking tools.

 

a) Google Analytics

For the purpose of designing and continuously optimizing our pages according to your needs, we use Google Analytics, a web analysis service of Google Inc. (https://www.google.de/intl/en/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). In this context, pseudonymized user profiles are created and cookies (see section 4 below) are used. The information generated by the cookie about your use of this website such as

  • Referrer-URL (the previously visited page)

is transferred to a Google server in the USA and stored there. We use social plugins from the social networks Facebook and Instagram on our website on the basis of Art. 6 para. 1 sentence 1 lit. f DSGVO Social Plugins to make our company better known. The underlying advertising purpose is to be regarded as a legitimate interest within the meaning of the DSGVO. The responsibility for data protection compliant operation is to be guaranteed by their respective providers. The integration of these plug-ins by us is carried out by means of the so-called two-click method in order to protect visitors to our website in the best possible way.

 

a) LinkedIn

Our website uses features of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA.

Each time you access one of our pages that contains LinkedIn features, a connection to LinkedIn’s servers is established. LinkedIn is notified that you have visited our sites using your IP address. When you click on the LinkedIn “Recommend” button and are logged into your LinkedIn account, LinkedIn is able to associate your visit to our site with you and your account. We would like to point out that we, as the provider of these pages, have no knowledge of the content of the transmitted data or its use by LinkedIn.

The use of the LinkedIn plugin is based on art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the widest possible visibility in the social media.

b) Xing

Our website uses functions of the network XING. The provider is XING AG, Dammtorstraße 29-32, 20354 Hamburg, Germany.

Each time one of our pages containing XING functions is called up, a connection to XING servers is established. To the best of our knowledge, no personal data is stored. In particular, neither IP addresses are stored, nor the usage behavior is evaluated.

The use of the XING plugin is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the widest possible visibility in the social media.

  1. Rights of data subjects

You have the right:

  • to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you may request information on the purposes of the processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned duration of storage, the existence of a right of rectification, cancellation, restriction of processing or opposition, the existence of a right of appeal, the origin of your data, if not collected by us, as well as the existence of automated decision making including profiling and, if applicable, meaningful information on the details thereof;
  • in accordance with Art. 16 DSGVO, to demand without delay the correction of incorrect or incomplete personal data stored by us;
  • pursuant to Art. 17 DSGVO to demand the deletion of your personal data stored with us, unless processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • pursuant to Art. 18 DSGVO, to demand the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to delete it and we no longer require the data, but you require it for the assertion, exercise or defense of legal claims or you have lodged an objection to the processing pursuant to Art. 21 DSGVO;
  • in accordance with Art. 20 DSGVO, to receive your personal data that you have provided us with in a structured, common and machine-readable format or to request that it be transferred to another responsible party;
  • in accordance with Art. 7 para. 3 DSGVO, to revoke your consent to us at any time. As a result, we may no longer continue data processing based on this consent in the future and
  • to complain to a supervisory authority in accordance with Art. 77 DSGVO as a rule, you can turn to the supervisory authority of your usual place of residence or workplace or to our headquarters.

 

  1. Right of objection

If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, if there are reasons for doing so that arise from your particular situation or if the objection is directed against direct advertising. In the latter case, you have a general right of objection, which will be implemented by us without indicating a special situation.

  1. Data security

We use the common SSL (Secure Socket Layer) method in connection with the highest encryption level supported by your browser. As a rule, this is a 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is being transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser.

We also use suitable technical and organizational security measures to protect your data against accidental or deliberate manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
